Terms of Service

These Terms of Service ("Terms") govern your use of the Noogat app ("App"), operated by Matt Fredrick ("we," "us," or "our"). By using the App, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent that you meet this requirement.

2. Your Account

You are responsible for maintaining the security of your account. You must provide a valid email address to sign up. You may not share your account with others or use another person's account.

3. Your Content

You own the ideas and text you capture in the App ("Content"). By using the App, you grant us a limited license to store, process, and transmit your Content solely to provide the service (including AI tagging).

You agree not to use the App to capture or store content that:

Violates any applicable law
Infringes any third-party intellectual property rights
Contains malware, spam, or other harmful material

We reserve the right to terminate accounts used in violation of these Terms.

4. AI Tagging

The App uses AI to automatically tag your ideas. AI-generated tags may be inaccurate or inappropriate. You are responsible for reviewing and editing tags. We are not liable for decisions made based on AI-generated tags.

5. Subscriptions and Billing

The App may offer a paid subscription ("Pro") that unlocks additional features. Subscriptions are billed through Apple's App Store and subject to Apple's payment terms. We do not process payment information directly.

Free trials, if offered, convert to paid subscriptions unless cancelled before the trial ends. You can cancel anytime through your Apple ID subscription settings.

6. Service Availability

We provide the App on a best-effort basis. We do not guarantee 100% uptime or uninterrupted access. We may modify or discontinue features with reasonable notice.

7. Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

9. Account Deletion

You may delete your account at any time through Settings → Delete Account. Deletion is permanent and immediately removes all your ideas and your account record. We cannot recover deleted accounts.

10. Changes to These Terms

We may update these Terms. We will notify you of material changes by updating the "Last updated" date above. Continued use of the App after changes constitutes acceptance.

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
